    Classification of felonies in Indiana

    Indiana laws break down felony criminal violations into five distinct classes.  The seriousness of the crime determines the classification of the felony charge that accompanies it—and, thus, the terms of punishment that result.

    Murder: A murder classification can result from a criminal charge of murder, manslaughter, rape, kidnapping, or arson.  Punishable by 45 to 65 years of incarceration and fines up to $10,000, murder is the most serious felony charge in Indiana.  Additionally, murder is a capital offense that can result in the death penalty, in some circumstances.

    Class A felony: A Class A felony occurs with criminal charges such as:

    • Armed robbery resulting in injury
    • Dealing over three grams of cocaine, methamphetamine, or a narcotic drug
    • Arson
    • Burglary
    • White collar crimes
    • Rape
    • Kidnapping
    • Child molesting 

    Class A felonies are punishable by 20 to 50 years of  incarceration and fines of up to $10,000.

    Class B felony: Class B felonies occur with criminal charges such as:

    • Burglary
    • Dealing less than three grams of cocaine, methamphetamine, or a narcotic drug
    • Arson
    • Aggravated battery
    • Sexual crimes
    • Child solicitation
    • Sexual misconduct with a minor, using deadly force

    Class B felonies are punishable by six to 20 years incarceration and a fine of up to $10,000.

    Class C Felony: Class C felonies occur with crimes such as:

     

    • Intimidation with a deadly weapon
    • Dealing with or possessing marijuana in an amount in excess of 10 pounds
    • Possessing cocaine, methamphetamine, or a narcotic substance in an amount in excess of three grams
    • Theft
    • Stalking, with an order of protection in effect

    Class C felonies are punishable by two to eight years of jail time and a fine of up to $10,000.

    Class D felony: Class D felonies occur with criminal charges such as:

    • Cruelty to animals
    • Criminal confinement
    • Theft
    • Residential entry
    • Maintaining a common nuisance
    • Dealing with or possessing marijuana in excess of 30 grams 

    Punishable by six months to three years of incarceration and up to a $10,000 fine, certain Class D felonies may be lessened to Class A misdemeanors through Alternative Misdemeanor Sentencing.
